India Approves 60 Day Special Maternity Leave in Case of Infant Death

 



The Indian government has recently approved a 60-day special maternity leave for women who have suffered the loss of a child. This new policy is a step towards acknowledging and supporting the emotional and physical needs of women who have experienced the tragedy of infant loss.Under the Maternity Benefit Act of 1961, women in India are entitled to 26 weeks of paid maternity leave. However, until now, there was no provision for women who lost their children shortly after childbirth. This often resulted in women being forced to return to work before they were emotionally and physically ready.

 The new policy, which was approved by the Labor Ministry and the Women and Child Development Ministry, will allow women who experience the loss of a child to take an additional 60 days of leave. This leave can be taken immediately after the standard maternity leave period or at a later time within a year of the loss.

 This policy was proposed after a woman named Pratiksha Baxi, who lost her child shortly after childbirth, petitioned the Delhi High Court to recognize the need for special maternity leave for women in her situation. Baxi’s campaign gained widespread support and ultimately led to the government’s decision to approve the policy.

 The loss of a child is a deeply traumatic experience for any parent, and it is essential that women are given the time and space they need to grieve and recover. This new policy will provide women with the opportunity to take the necessary time off work to heal and begin the process of moving forward. 

 The policy has been widely welcomed by women’s rights activists and organizations. Many believe that it will encourage more women to speak out about their experiences and seek the support they need. It is hoped that this policy will also pave the way for further reforms in India’s maternity leave policies, including the extension of maternity leave to women in the informal sector.
